5. Milestone Tokens and Digital Assets

Our Services allow you to buy, sell, trade, stake, and otherwise interact with Milestone tokens and other digital assets. By using these features, you acknowledge and agree to the following:

• Digital assets are not legal tender and are not backed by any government
• Digital asset transactions may be irreversible, and losses due to fraudulent or accidental transactions may not be recoverable
• The value of digital assets can be highly volatile and unpredictable
• You are solely responsible for determining any tax consequences of your transactions
• We do not provide investment advice, and any information provided through our Services should not be considered as such

You are solely responsible for the security of your digital assets, including maintaining the security of your wallet and private keys.

6. Fees and Payments

We may charge fees for certain Services. All fees are stated in the applicable digital asset and are exclusive of any applicable taxes. We reserve the right to modify our fees at any time with notice to you.

In addition to our fees, transactions on blockchain networks may incur network fees (gas fees) that are not controlled by us and vary depending on network conditions.

All payments and transactions are subject to our anti-fraud and compliance controls. We reserve the right to delay, cancel, or reverse any transaction if we suspect the transaction involves fraud, violations of law, or violations of these Terms.

7. Intellectual Property Rights

Our Services and content (excluding content provided by users) are owned by us or our licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for their intended purposes, subject to these Terms. You may not:

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICES WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
• ANY ERRORS OR DEFECTS WILL BE CORRECTED
• THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE OR (B) $100 USD.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold us, our affiliates, directors, officers, employees, agents, and contractors harmless from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.

THESE TERMS EVIDENCE A TRANSACTION IN INTERSTATE COMMERCE, AND THUS THE FEDERAL ARBITRATION ACT GOVERNS THE INTERPRETATION AND ENFORCEMENT OF THIS PROVISION.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website or through other communications. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and without notice or liability to you. Upon termination, your right to use the Services will immediately cease, and all provisions of these Terms that should survive termination shall remain in effect, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.
